The life sentence over pot possession days are long over. The only time I was ever 'caught', the cops gave me a ticket and took my stash.

Doesn't it depend on the particular state and whether it's the offender's 'third strike'... or not?

Sometimes the law is an ass.

To a degree, yes.

These days, most states understand the cost of incarceration over marijuana is greater than the crime against the state. Except in rare states (Texas) and circumstances, even a 2-time felon will get off on pot possession.

I'm speculating, of course. Each case will be determined by the strength of the case and the quality of legal representation.

What Are Federal Marijuana Laws?

Under federal law, marijuana is considered a Schedule I substance and it is illegal to use, possess, cultivate, or distribute. While each state has its own marijuana laws, they cannot overturn or preempt federal law. Therefore, it is important to understand the federal penalties for marijuana possession and distribution.

There are many sentences in the article that cry out against the mandatory sentencing laws. If this guy gets a decent lawyer he can argue on the grounds of the eight amendment. He might just die first, at the tax payers expense.

A update, with a tad more info about the arrest, in today's news:

Engrish:

"Cambodian and FBI arrests US man for raping

The American man was arrested on Friday.

A US man was arrested by Cambodian authorities and FBI officials on Friday night at a restaurant Sangkat Chamkar Samrong, Battambang Province.

Provincial police chief Seth Thit said that local authorities have been working with FBI agents for almost two years to find and arrest him. The man is Robert (Bob) James Boehnlein.

"We only cooperate and bring force to the whereabouts of the suspect," he said. "The suspects are always in Battambang and Siem Reap," he added.

Boehnlein was convicted of sex and molesting with a minor under the age of 16 in Texas in 2002.

According to military court records, Boehnlein sexually assaulted his daughter for many years.

Boehnlein fled the United States briefly in 2000 after his sexual assault was reported to the authorities after This man was hiding in Mexico for two years, teaching English at a school.

According to the list of sex offenders in Louisiana, US Boehnlein was released from detention in 2011 and moved without notifying the authorities.

US State Department spokesman, Arend Zwartjes, declined to comment on the case, but confirmed by email that the US government and Many other law enforcement agencies are proud of the cooperation, and he says he is really pleased with the Cambodian authorities in the fight Against This international crime.
"

(Now that I look at it more closely, I think the Khmer press just Google Translated the Phnom Penh Post article. Good to know it goes both ways, LoL.)
