American Fugitive JAN STERLING HAGEN Arrested Outside US Embassy in Phnom Penh, Cambodia
Re: American Fugitive JAN STERLING HAGEN Arrested Outside US Embassy in Phnom Penh, Cambodia
It’s a long story but they can charge you with anything they want. The “victim” was in her own apartment - with her friends (and boyfriend) and even some of her family - Drinking.
Kidnapping means restraining someone.
Sexual assault 2 means sexual contact without consent - sexual contact means “intentional touching, either directly or through the clothing, of the genitalia, anus, groin, breast, inner thigh, or buttocks of any person.”
All that for a prolonged drunken bear hug from behind with a hand on her breast, in front of everyone, including her boyfriend. They went the whole night partying and he didn’t even know he did anything wrong. He returned the next morning because he forgot something at the apartment and the couple was acting weird when they answered the door. They tried to slam the door on him when he said he wanted his thing back, and he put his foot in the door. Got hit in the face and they shut the door. Charged with burglary.
The next day, the girl filed a police report and said she was sexually assaulted. After lots of questioning and leading questions, they decided to charge him with all of the above. And they always tack on those other charges to make plea bargains sound more appealing. Well since Alaska has extremely sexual assault or domestic violence laws, he was looking at 15-30 years. Even though a decent lawyer would have easily been able to win the case and probably lead him of every one of the BS charges, he was too scared to chance it when looking at a MINIMUM of 15 years. So he took the plea bargain and plead guilty and they dismissed a few of the charges and reduced the sexual assault charge to just assault. Made it 95% of his 5-year probation and got a DUI. Another fun case. He wasn’t even in his vehicle.
PS: don’t move to Alaska.

His father flew there to retrieve him and paid for his ticket home. They are currently en route to the states.phuketrichard wrote: ↑Fri Mar 16, 2018 8:57 amassume he had $$$ as the US, WONT pay to repatriate you back to the states. AS he was NOT arrested by the US authorities..while waiting out front of the embassy for a tuk tuk driver, local authorities nabbed him and put him in the van. They took him to the Department of Immigration where’s been detained for two days. He will be escorted back to Alaska on a flight within a couple of days.
We have an outreach program for US citizens here in Phuket,3x /year the US consolur comes down to allow us to
get a new passport, get a notary, file report of child born abroad, ask for assistance etc etc.
this trip down the head consolur came down and explained what the US embassy can and cant do for a US citizen.
very informative

Thank you for this version of events. Will the police report and court documents say something wildly different, if someone were to obtain those documents from the Kenai Superior Court?AKL wrote: ↑Fri Mar 16, 2018 3:03 pm It’s a long story but they can charge you with anything they want. I would love to see what the documents said. It never went to trial so there isn’t court documents per say. But I’ve talked to someone who has listened to the recording of the “victim” and they said she changed her story a couple times and the police report had blatant lies in it. Also, this girl has made the claims before, there’s a pattern. Her own sister posted on Facebook about how she didn’t believe her story. I’m telling you it was a ridiculous easy case to prove his innocence. But you never know what can happen with stuff like that. It’s hard to say I wouldn’t have taken the plea bargain if I was looking at a minimum of 15 years too.
Jan has drugs and alcohol problem, he is not a criminal.

But almost every convicted criminal says "I was totally innocent and the victim set me up and I only pled guilty because they overcharged me and my lawyer advised me not to risk going to trial."
Re: American Fugitive JAN STERLING HAGEN Arrested Outside US Embassy in Phnom Penh, Cambodia
I call your “almost every” and raise you an “EVERY”. Every INNOCENT person says “I’m innocent and the victim is making up stories.” His lawyer actually said he should go to trial. But when you’re 20 years old and you’re facing those kind of jail times, that’s a tough call on a he-said/she-said case.
My theory is that the couple got scared he was going to press assault charges on them when they knocked him in the face at the door. They grabbed a big steel MagLite flashlight and split his eye open. I’ve seen police pictures of the asphalt in front of the apartment. It was a HUGE pool of blood, photos taken the next day. They didn’t file a police report of “sexual assault” until two days AFTER the alleged incident. That would be my only thought of a motive to file a false report. That couple has truly ruined this kid’s life.

But you don't get to force yourself into someone's house just because you think you left something there.
Was he at least guilty of the habitual drunk driving or he was he the victim of overzealous law enforcement in those cases too?

Re: American Fugitive JAN STERLING HAGEN Arrested Outside US Embassy in Phnom Penh, Cambodia
He put his foot in the door to stop the door from shutting on him. He didn’t “force himself” into someone’s house. He never even entered the house. Let’s give him a couple years for that. And yes he is definitely at fault for drinking and driving.
But now talking to people on here, makes me think he made a good choice of not going to trial to convince a jury that he’s innocent.
