What a joke. The problem is not that "it puts Cambodian lawyers at a disadvantage", the problem is that it doesn't allow the bar association to line its pockets as much as it could. There are probably hundreds upon hundreds of Cambodians who have studied law, but haven't "passed" the closed door bar exam (in front of a panel of 10 senior members of the bar)... If you're not from a rich background (to pay up), you're basically not going to become a member, no matter how good you are.

I'm watching on the sidelines as Cambodian 'lawyers' and 'courts' go to work on 2 cases which involve me very indirectly.

1st is a messy divorce dispute and family squabble, which can be solved by both parties handing over $2000 to the judge.

2nd is a criminal case where $4000 has been given to pay the court and get a guy out of Prey Sar. A week later and he's still inside (maybe 1 week more and then no problem.....)

Obviously we've all heard about this sort of behaviour as standard procedure, but it's still interesting to see firsthand. $4000 seems, in these cases to be the going rate.

As far as I am aware for a foreign lawyer to be registered there has to be reciprocation, in that the Khmer bar association has to be recognized in the foreigners country, and there appears to be a reluctance to accept the Khmer bar association in certain countries.

The lawyer in question has Khmer citizenship so he can practice anyway.
