Hello everyone,
An acquaintance of mine has a visa problem that i can't help him solve easily.
His passport will expire in 7 months, he is on a EB visa and which will expire in a week.
He is regularly employed by a consulting firm but their agent told him that "7 months is too short cant renew, not even 3 months".
He has no embassy here for a new passport nor he can fly back as he comes from a less than fortunate country flying to which is extremely complex now.
He came to me for help but i would like to avoid bothering my connections in the MOFA if someone has an easier solution as I know that they don't like sorting this sort of issues.
It seems a bit unfair to me that since his passport his not yet expired that he is going to get stuck here with no visa even if he has done everything by the book so far. He can lose his job and have a bunch of issues if he gets stuck in this situation.

I know someone in the same position (well, his children are). Their passports have expired and they can't get a new one without leaving the country too. They solved it with a temporary 1Y (Laissez Passez?) passport which can be applied for from abroad. It's a costly affair though, they have to get a new passport plus new visa every 3 months because of the 6 month validity law. A one year passport isn't enough for a 6M visa in real life.

Which country is he from? I had this exact issue, but being English I was able to apply for a new passport online, courier my old one back to the passport office (seal it up & list it as "documents", else the courier won't touch it), get the new one delivered to a relative's address (small white lie needed) and then couriered back to the Kingdom of Wonder (again sealed, bla bla). I ended up with a one week overstay to pick up, but it worked.
If there is any way he can apply online in his home country & handle the logistics via courier, it is possible.
Oh and screw VFS Global who made me find this alternative through their dithering incompetence ...

What are the exact dates that his current Visa/EOS and passport actually expire?
He may be able to get a 1 month EOS if, as mentioned above, there are at least 6 months validity remaining on the passport from the new Visa EOS expiry date.
That would at least give him a little additional time to get his shit sorted.
Prior preparation and planning prevents piss poor performance.

I was in same situation. Tried everything, some Khmer friends tried to intervene without success. I had to fly home to get new passport. Not fun and expensive. He can still get one month visa.

So i guess there is nothing to be done?

He's fucked. If his passport expires Nov 15th there's no room for even a one month visa because next working day is April 19th, 4 days due. Only a temporary passport can save him, or he has to pay overstay fees and then sent back with a possible ban.

Yea, his only real option is to leave the country or continue to stay here illegally racking up overstay fines and the risk of deportation and blacklisting. As stated above he isn't even eligible for a 1 month EOS.
He could try contacting the Iraqi Embassy in Hanoi to enquire whether or not he is eligible to apply for a new passport, but from what I understand the applicant must apply in person and provide fingerprints on site, so I don't rate his chances. One of my Iraqi colleagues has been waiting nearly 2 years to receive his new passport which he applied for from within Iraq! Cambodian bureaucratic procedures are hassle free compared to Iraq.
Iraq doesn't issue temporary passports, only "Special Passports" aka. Emergency Travel Document or Laissez-passer, for those with an expired, damaged or lost passport, and it is only valid for 30 days to travel back to Iraq on.
There is nothing complex about flying to Iraq currently, especially as a Citizen, I've flown into Iraq twice in the past 7 months, and we have other foreigners flying in weekly. He'll just need a PCR test conducted no more than 72hrs prior to departure, most viable route at the moment is:
PNH - ICN - DOH or DXB - BSR or BGW
At least he'll be able to spend Ramadan and Eid with his family.

You could try this information below, although I find it odd that it's a consulate-general. An embassy is usually the correct diplomatic representation in a country's capital. Or yes, the one in Hanoi as mentioned above.

So i will tell him to pack up his luggage and that he is going to spend a few grands going there and coming back. Hopefully he will be able to do it quickly since there are flights.
To be honest I didn't think that the "extra 6months" rule was that seriously taken in consideration.
I don't really understand why is it so important to be a law in the first place.
