I know at the time I left Koh Kong already there seemed to be small change happening in the way of Chinese investment, and on a visit back at one time I had been told by two Khmer restaurant owners (but renting the properties) on the main street, with uncertainty they need to earn. They told me that their leases end in less then a year and would not be renewed to them. Chinese tenants have secured the new leases.
So if you work and/or own a business you should have an EB AND a WP. No question.

You can’t own a business and then claim you don’t work there so don’t need a WP. At some point you’ll have to do something to do with the business - buying stock, ringing suppliers, working the bar of short staffed etc.

If you don’t work (and don’t intend to but are under 55 and can’t get an ER) but have an EB and no WP then immigration don’t care. I was asked why I had an EB and I simply said I couldn’t get an ER. He asked if I worked and I said no. Not in six years. He says “If we catch you working we will fine you and maybe deport you. Ok?”

If you hold a EB and no work permit! How do you manage to get a EB EOS. Think about this, if you have had a EB for 6 years and no work permit, immigration can charge you back payment for 6 years. So it could end up like your saying, or back pay $600 plus fine if they wish.

No. You only get fined if you apply for a WP.
You’ll either get another EB or EG or a ER if your lucky.

No fines if you don’t actually want an EB.

And if any case it’d be cheaper to “lose” your passport.

Work Permit is not required as supporting documentation when applying for a 6 or 12 mth EB EOS (although that appears to be changing for EB renewals, but nothing official yet).

Immigration can not charge you back payment for not having a WP...but if you do eventually apply for a WP then the MoLVT can/will charge you retroactive fees for the years in country on any E-type Visa EOS without a WP.

Local Sangkat has no authority over Labor related issues...walking around selling pies legally would have required you to have a registered business (MoC) and Work Permit (MoLVT) and EB EOS (DoI). Doesn't really matter now though, as your pie hawking business is one of the professions foreigners are banned from.
