I'm actually not any dispute with them yet but they probably are scalping it and I find that irritating, just deciding wether to make it an issue or not. It's up to your employer to pay tax so they are in the wrong. You should study the labor laws, you are probably covered by them. I've seen successful outcomes of labor court disputes here where unfairly dismissed people got good payouts. Depending on who you are having the dispute with this might or might not work.
