Have I been scammed, and if so, who by?

Post by sousadeyy »

Hello dearest expat Community,

So.

Visa expired on the 28th September. Dropped it on today, expecting a 30$ fine no problem.

Get to the usual travel agents whom I trust as they deal with the vast majority of my workplaces visas.

They tell me I have a $510 overstay fine. 51 days. WWHHHAATTTTTT!!!!!!

Im a longterm expat of Cambodia, but I had to return to the UK for family reasons earlier this year. I had to rush back, and in the period whilst I was back my visa expired.

No problem. Get a visa from the Cambodian embassy in London.

Provide me with a 3 month business visa. Valid from June 28th to September 28th.

Arrive in the country 15th July.

The travel agents tell me that immigration should have told you, but they only stamp for 1 month arrival even though you were issued a 3 month visa. So I'm paying the fine from 15 August until September 1st.

Its Cambodia. What can I do. I paid the fine.

But this doesn't seem right?

Opinions, experiences?

Here is a brief explanation I wrote due to the amount of people who were getting hit with overstay fines...

VISA IN ADVANCE DATES EXPLAINED:
Since so many people still seem to get confused by this, and most Embassies/Consulates don't explain it when issuing visas in advance.

The Issue Date & Expiry Date annotated on an E-type Visa STICKER (see pic) issued in advance from a Cambodian Embassy/Consulate indicate the period that the Visa is valid to use for initial entry into Cambodia only. These dates do not indicate the period of Stay permitted.
ie. Issue date 02nd Jul 20 - Expiry Date 02nd Oct 20...you can use the visa anytime within that period for your initial entry into Cambodia.
These dates do not mean that you can enter on 02nd Jul and stay until 02nd Oct.

Upon arrival, you are granted a 1 month period of stay from the date you arrive. This will be annotated on the Entry STAMP (see pic) placed in your passport. In order to stay in Cambodia longer than 1 month, you must apply for an Extension of Stay prior to the "Until" date annotated on your Entry Stamp.
ie. Arrive on 17th Jul 20, period of stay permitted until 17th Aug 20. (NOT 02nd Oct as stated on Visa Sticker.)

Far too many people fail to research and understand this, and therefore end up on overstay, and then feel they are getting scammed and/or asking how they can get the overstay fines waived...well, unfortunately they can't, they will have to pay the $10 per day overstay fine to obtain an EOS or to leave the country. @sousadeyy, expensive lesson learnt, but you are not alone, I receive PM's from people on farcebook almost daily who have made the same mistake.

Yes, just a simple costly mistake, PSD-Kiwi explains the workings well has always. The pandemic has not made things easy for some, but on the other hand it has for some. Since on the subject of visas, the ones who entered on a months tourist visa, and then closers of the borders have left some, a few stranded here, so the Government and Immigration have wavered the visa costs, so some would be staying here on that initial tourist visa. I know that agents are prepared to change their visas over for one of the E EOS, but I have noticed that comes in at quite a cost over and above the normal agents and Immigrations price of the EOS. That's the thing here, when there is chance to cash in on a opportunity, then there could be a chance of getting scammed at the same time.
Always "hope" but never "expect".

The Government has been extremely generous by granting automatic extensions/waiver of overstay fines for those "stuck" here on expired Tourist Visas, I am very surprised that they haven't put an end to it yet, but with all the talk of potentially opening back up I predict it won't be long till they do end the exemption. The DoI made a good decision to allow conversion from an expired Tourist Visa to an EB EOS, at least that allowed for those stuck here to work legally without fear of repercussions, and the $100 conversion fee on top of the Visa fee is peanuts considering these people have been staying in Cambodia visa free for well over a year.
