Post by Aussy »

My nephew wa run over at his fruit stand in front of his home, he died from his injuries after life support proved insufficient, the driver of the car was drunk in the village and it appears he has bribed police and will get off without any jail or compensation, is there anything I can do for justice in this case

In Cambodia generally whoever has the most money wins. If you have the resources to hire a lawyer and make all the necessary payments to the right people it is possible to obtain justice. It sounds bad but in reality the same principle applies in western countries too. If you need a lawyer I have one but he is very busy and may or may not agree to take on your case. Again it comes back to the question of money.

I don't have the details but the dear leader has comissioned 50? lawyers to help people find justice, free of charge. This is why some expat clowns have been given citizenship lately. If you can contact these guys you might get justice. I hope you do, similar stuff has happened to two people I knew. The rule of law here appears to only apply to the plebs... Absolutely tragic.

Btw, seems odd and out of line that no compensation was offered/paid to the family. Unusual. Make some noise! Easier said than done, of course. Good luck.

No, I mean that Alaskan bloke down in Kampot was helped by this lawyer team and I assume the guy who had a feud over land with his wife also had these guys mediate/advocate on his behalf. I will try to add a link here tomorrow. It's a good populist move by The Man. Helping the disenfranchised to get some justice for land grabbing etc.

And I say clowns because for sure that Alaskan at least was bending the rules on his property development. Sen Somnang or some such...

Sure you can, and your starting point is a list of lawyers such as this one legally authorised by the Cambodian Bar Association to practice law in Cambodia, in accordance with the National Assembly Law on The bar, and to appear before courts in Cambodia.

https://www.hg.org/lawyers/cambodia

A related question could be...can you afford any of them? Especially so if you want to be represented by one of the large international law firms operating in Cambodia.

The Cambodian Bar Association is very close to being a "closed shop" and it takes a substantial sum of the folding stuff and good contacts to open the door.

One thing to bear in mind - if you insist the law acts and is enforced properly on others, be prepared for the other side to use similar tactics, especially if they have contacts. You had better be squeaky clean on the visa/WP/FPCS front, no dodgy employment letters, etc

Good luck, and sorry for your loss

The free lawyers I was referring to are the PMs Legal Aid Team but upon checking this is well outside of their scope. So I'm completely wrong there. My mistake.

But I would suggest contacting Licadho. They should be able to help or at least point you in the right direction.
