Australian father takes Khmer child to Australia without permission - allowed?
Australian father takes Khmer child to Australia without permission - allowed?
Asking on behalf of someone else.
A Cambodian girl and Aussie man have a child together, currently young. Parents never married, only documents available are two passports (Khmer and Australian) and birth certificate.
Father requests the passport to take them to copy (both Khmer and Aussie) and takes the child 'for a coffee'. Next we know the child is Australia, without mother's permission.
What steps could the mama take, if any? Father has no documents of mother passing away or been given child custody.

It's possible, but you have to be a bit discreet.

Contact the Australian embassy they will probably put her in touch with the Australian Federal Police. If they have actually gone to Australia then the father is in deep shit.
I tried to get the dole once listing my daughter, it was rejected because I had no written permission from her mother to have her there

i used to travel with my daughter( before ex and i split) out of thailand, ( in SE asia and also back to the states) never had her permission or a letter, never asked
If he is the rightful father, (name on BC and childs passport is his last name), for many countries... no law broken.
SOME require a permission letter from mom to leave

The fact that he lied is proof he knew it's illegal at worst and very dodgy at best.
Not sure Australia will be a better environment, given what I hear from Australians.

Dodgy or not, it's not up to me to decide. I know in general many Western countries have laws in place that give the mother more rights than the father if the child is born outside of legal marriage. If for instance, I would to the same under the same conditions and take my child to my country without permission of the mother, the mother could complain with the embassy and I would indeed be in trouble.that genius wrote: ↑Mon Feb 05, 2018 7:44 am The fact that he lied is proof he knew it's illegal at worst and very dodgy at best.

Just wondering if this is the same in Australia, or does Australia grant equal rights to the father and the mother in case they have a child together outside of legal marriage.

If you had no documentation then the mother will win. The father will probably be done for transnational abduction and have a nice taxpayer funded holiday.

thailand that is not true, I was not married the first 4 years of my daughters life an often traveled with her. Then went to court ( after 3 years of marriage) to obtain divorce & sole custody, the thai court takes the best interest of the child when giving their decisions. Even a farang is NOT at a disadvantage ..Kammekor wrote: ↑Mon Feb 05, 2018 8:58 amDodgy or not, it's not up to me to decide. In Australia the father has zero rights, the only right a father has is to pay child support.
In this situation the mother will need to contact AFP .
Properly take a few years to get the kid back to cambodia maybe longer if the father has gone offgrid.
Australia is a great country with a good healthcare system in place, not to mention great business opportunities.
