What visa could the kid be under? Would've thought that would be the first hurdle, no?

so in a case of a custody hearing , the best interest of the child are not taken into when assigning custody? cant believe Australia is that backwards..Micmac wrote: ↑Mon Feb 05, 2018 9:31 am In Australia the father has zero rights, the only right a father has is to pay child support.
In this situation the mother will need to contact AFP .
Properly take a few years to get the kid back to cambodia maybe longer if the father has gone offgrid.
Australia is a great country with a good healthcare system in place, not to mention great business opportunities.
has Australian passport...visa not needed....What visa could the kid be under?

If I were the Aussie father I would fly to Bangkok, leaving Cambodia on the Cambodian passport (no visa needed) and continue on the Australian passport from there. Leaving the country, nor entering Australia, was the problem I guess. The question is: what rights does the mother have in this case, and how to enforce - assuming the mother wants to.Barang chgout wrote: ↑Mon Feb 05, 2018 9:36 am What visa could the kid be under? Doubtful there would be a custody hearing, the father has kidnapped the child and taken it across international borders, numerous cases the the other way in Australia which the father kidnaps the child and takes it to a country with no extradition treaty with Australia.

Didnt the OP state the child has a Australian passport? If so, no visa is required.Barang chgout wrote: ↑Mon Feb 05, 2018 9:36 am What visa could the kid be under? Would've thought that would be the first hurdle, no?

@richard for a father to win 100% custody he would have to prove the mother is unfit, which is hard .unless she has prior convictions for drug/child abuse etc.

The op is a bit unclear to me as to whom has what passport. If the kid has an Aussie passport, how?

In some ways Richard Australia is behind the times in regards to family law.
If it was me I would bypass the OZ embassy in Cambodia.
Get an alert on his and the childs passport so he cant leave Oz

You apply for Australian citizenship at VFS Global in Phnom Penh Tower, once that is received you apply for an Australian passport at the embassy, it's not a difficult process.Barang chgout wrote: ↑Mon Feb 05, 2018 10:03 am The op is a bit unclear to me as to whom has what passport.
