Ministry seeking to block surrogate children’s papers

Cambodia’s Ministry of Foreign Affairs is actively working to identify cases of commercial surrogacy – and has already refused to authorise some birth certificates – in an effort to prevent foreign intended parents from leaving the Kingdom with children delivered by a surrogate mother, officials said this week.

“We consider [surrogacy] as a new kind of human trafficking and our ministry is in position to prevent such crime,” Samnang Tho, director of the ministry’s Legal and Consular Department, said in an email.

In order for intended parents to leave Cambodia with a child born to a surrogate, the parents must obtain a birth certificate from a local official and have it translated and legalised by the ministry, Tho explained. But the ministry is now refusing to legalise birth certificates when it’s suspected that the child was born through surrogacy.

“If the child was born from a Cambodian and a foreigner, we will check their married [sic] certificate and the passport and visa of the foreigner,” Tho said.

The ministry has refused to legalise about 10 birth certificates thus far, and is working with foreign embassies, particularly the Chinese Embassy, to flag these cases, he added...

Officials Ask Foreign Couples To Claim Babies of Surrogates

Officials are seeking the foreign couples who hired Cambodian women to give birth to their babies through a recently arrested broker, saying they will be allowed to take the children home as long as they step forward and take responsibility for them.

On Thursday, Chou Bun Eng, secretary-general of the Interior Ministry’s anti-human trafficking and sexual exploitation committee, said the focus had shifted from cracking down on the brokers to trying to care for the pregnant women.

“We want to see responsibility. If the babies leave the country with good parents and care, we won’t mind it,” Ms. Bun Eng said. “We want to know where these women are. They are hiding because they have seen our crackdown.”

The identities of the foreign couples were not yet known, she said. The pregnant women were not told who their babies’ biological parents were, and the arrested brokers had yet to reveal their clients’ identities, Ms. Bun Eng said.

Suspecting that several of the parents are Australian, Cambodian officials met with NGO representatives and Australian Embassy officers on Thursday for two hours, she said...

As events continue, Cambodia has decided that the surrogate arrangements organized by Tammy Davis-Charles will be permitted to go ahead, but the surrogate agent will remain in prison. It is likely that she will be released once Cambodian authorities have been informed of the identities of all concerned, and once terms and conditions have been agreed on by the two parties.
For the moment, other surrogacy agencies are not concerned with this amnesty by the Cambodian authorities. It is possible that they are planning on negotiating agency by agency, but so far attention has been very much focused on this one particular agency, Fertility Solutions PDG.

Cambodia has offered a limited amnesty to Australians who have paid for surrogacy services, saying they can collect their babies without fear of arrest.

The assurance comes a week after Australian nurse Tammy Davis-Charles was arrested in Phnom Penh for operating a surrogacy agency and allegedly falsifying documents.

The Cambodian Government wants Australian intended parents to fulfil their financial commitments to surrogate women, who stand to earn $13,500.

"I can guarantee they will be safe if they [take] the responsibility for those children," said Chou Bun Eng, permanent vice-chairwoman of the National Committee for Counter Trafficking.

The amnesty will only apply to the 23 pregnancies that were arranged by Ms Davis-Charles...

Ok. We can all be sorry for the prospective parents, BUT this is official Australian government advice from 2014, warning Australians against all commercial surrogacy arrangements in Cambodia - 2 years ago !
Much as I'm sorry for all the people caught up in this situation with the recent clampdown, you cannot say that you were not warned.

As for the surrogacy agencies, they are responsible for encouraging foreigners to continue with surrogacy arrangements in Cambodia when it was obvious that the whole business was going to go tits-up at some stage. Before I read this, the agencies had my sympathy to a certain extent because Cambodian law was not clear, but when you can see that the Australian agencies were duly warned years before, and they chose to carry on regardless, that's just greed. :evil:

Adopt the Babies: Government

Babies born from the recently-banned commercial surrogacy will not be allowed to be taken out of Cambodia unless their biological parents, most of whom are Australian, legally adopt them, the Interior Ministry said yesterday.

In a phone interview with Khmer Times, the ministry’s secretary of state Chou Bun Eng, who is also the head of the National Authority against Human Trafficking, added that the ministry would also not be acting on requests for the transfer of babies from the Fertility Solutions PGC surrogacy company, which was shut down after the recent arrests of its founder and two employees, pending the completion of the case.

“The Cambodian government has made three requests to the Australian embassy officials. First, do not take the babies out of the country,” she said.

“Second, identify those foreign parents and process their legal documents based on adoption laws. We will check whether they are qualified and third, we want both governments to work together and solve this problem,” she added after a meeting with Australian officials...

So, now the surrogacy companies that were kicked out of Thailand, then kicked out of Cambodia, are moving to Laos where there are no laws - yet. They know that it's just a matter of time before the Laos govt also clamps down, but they are happy to keep moving on until they get busted apparently. This can't be good for anyone - except for the surrogacy companies who, fully knowing the risks that are involved, keep telling desperate people that they can arrange babies for them... :facepalm:

Brokers who hired Cambodian women to carry the children of foreign parents before the practice was banned are now developing cross-border arrangements with Laos and Malaysia, according to U.S.-based advisory agency Sensible Surrogacy.

New Genetics Global, Talent IVF and World Fertility Services are among the companies that were operating in Cambodia before surrogacy was banned here earlier this month, and had already opened operations in Laos, according to Australia-based advocacy group Families Through Surrogacy...

For poor surrogates, a loaded bargain

In Kmounch village on the outskirts of Phnom Penh, at least six women have rented their wombs to foreigners over the past two years. There is little economic activity in the village itself, where women sit braiding each other’s hair, cooking over open fires or playing cards.

But each of the six surrogate mothers could receive up to $10,000 for her trouble – more than six and half times what a garment worker could make in a year on minimum wage.

In Cambodia, information about commercial surrogacy tends to spread by word of mouth, with women drawn to the industry through the recommendation of others. The first surrogate was recruited in the village almost two years ago, and gossip about payments for surrogate mothers spread like wildfire.

Now, the gossip is likely about how much longer such opportunities will exist in Cambodia. The government recently announced that it considers commercial surrogacy to be illegal...
