It seems reasonable to assume that Toby Nelhams must have quite a bit of money and/or be well connected. Negociations are probably underway at present, as he has yet to be charged or deported, despite the fact that he was previously reported to have been arrested on 5 Feburary. [Here they say "Tuesday", presumably 14 Feburary.]
Thai authorities, who were blaming the Cambodians for their lack of action,seem to be no longer actively seeking Nelhams deportation, but this could change. Stay tuned.

-A British businessman linked to a murder in the Thai resort of Pattaya has been detained for further questioning by the Phnom Penh Municipal Court as the mystery deepened over Thai authorities’ failure to seek his extradition.
Court clerk Leng Sokha said yesterday that Toby James Nelham was questioned by deputy prosecutor Seang Sok, but had not been charged.
Yesterday, officials from the British embassy were present during the questioning of Mr. Nelham, which took longer than normal because of the need for translation.
“His questioning has not completely finished yet. It will continue tomorrow [Friday],” he said.
Court spokesman Ly Sophana confirmed that the prosecutor had not decided whether to charge Mr. Nelham.
However, he declined to give any more details about the case.
Cambodia’s National Police have received a report from the Thais about the murder, but have not been asked for help in arresting the suspects despite widespread publicity about their flight into Cambodia.
Mr. Nelham was arrested on Tuesday after allegedly entering the country illegally and staying and working without proper documents.
He has been described as a web designer, but has known links to what are known as boiler room scams...
Mr. Sophana said police were seeking information on the Springtide International company of which Mr. Nelham was chairman in Cambodia.
The company is said to be based in Phnom Penh and in Preah Sihanouk and Siem Reap provinces.
Police are also trying to trace other people who are related to his activities.
General Chhay Sinarith, the Deputy National Police Commissioner, General Sopha, the head of the immigration police department at the Interior Ministry, and Interior Ministry spokesman Khieu Sopheak could not be reached for comment yesterday.

UPDATE: Toby Nelhams will be charged with illegally entering Cambodia and for lacking the proper documents, such as passport, visa, work permit, business licence. It is possible that he will be sentenced on these minor charges, given a hefty 'fine', and released or deported. If there is still no official request for his deportation to Thailand or an international warrant for his arrest, he will probably be free to leave the country.

However, Thai authorities had not requested Cambodia’s cooperation in arresting the suspects, he added.
Kong Sarith, an officer with the Interior Ministry’s immigration police, said Mr Nelham was the chairman of Springtide International, which was based in Phnom Penh. with branches in Preah Sihanouk and Siem Reap provinces.
“He was arrested by Cambodian immigration police because he illegally entered Cambodia and illegally stayed and worked in the country,” he said.
“He is accused of illegally crossing the border and illegally entering Cambodia, staying in Cambodia without authorisation and working in Cambodia without legal documents.

Uk Heisela, chief of investigations at the Interior Ministry’s immigration department, confirmed Mr. Nelhams’ imprisonment, but said he had no information about his alleged connection to the murder.
“The court charged him for not having a passport,” Mr. Heisela said, adding that he had not received a request from Thai authorities to extradite Mr. Nelhams, who had been living in Cambodia for eight years.
Mr. Heisela added that Mr. Nelhams was not cooperating with authorities.
“He did not speak with us. So we cannot learn anything,” he said.
On Thursday, a U.K. Foreign Office spokesman said in an email that the office was “in contact with the local authorities following the arrest of a British man in Cambodia.”

Caldeira’s former employer said the alleged hitman claimed he had just arrived in Phnom Penh when he began working at the bar “around six or seven months ago”. Facebook posts depict Caldeira in Cambodia as early as 2013, and seem to show that his mother lived in Phnom Penh.

Widow of Murdered Boiler Room Boss Wants Briton Toby Nelham Extradited from Cambodia
JOMTIEN – The widow of Briton Tony Kenway who was gunned down in broad dayligh in Pattaya is calling for the extradition of Toby James Nelham, 44, who reportedly ordered Kenway’s murder and was arrested in Sihanoukville last week.
According to the Pattaya Mail News, Somporn Kenway, went to Nongprue Police Station to push for the extradition of Nelham, believing that the UK was blocking Nelham’s extradition from Cambodia to Thailand, due to it having the death penalty.
Mr Nelham, 44, was arrested by Cambodian immigration police in Phnom Penh on Feb 15th and taken to Phnom Penh Municipal Court for questioning.
Toby Nelham is accused of hiring Briton Miles Dicken Turner, 24, and South African Abel Bonito Caldeira, 28, to kill Kenway after a falling out over their joint boiler room operation that swindled people in the U.K. and Australia out of their life savings through bogus investments.
Nelham allegedly owed Kenway 8 million baht and, when Nelham didn’t pay, Kenway ratted him out to police and tried to have him arrested. Nelham fled to Cambodia where he reportedly set up a similar call center operation which later failed, another thing for which he blamed Kenway...
