CHIANG MAI, Thailand — Defense lawyers for two Burmese migrant workers—who were sentenced to death last December, after convictions in the murder of two British backpackers on Thailand’s Koh Tao Island—say they expect a ruling from the Thai Court of Appeals by January.

Latest statement from Miller family back Thai court decision


The parents of Jerseyman David Miller, who was killed in Thailand in 2014, say they are confident the court has “made the correct decision” by upholding a guilty verdict in the trial into his murder.

Two Burmese men, Zaw Lin and Wai Phyo, were convicted of the murder of David and the rape and murder of Hannah Witheridge in 2015.

Today a Court of Appeal in Thailand upheld the guilty verdict handed down to the pair.

“Zaw Lin and Wai Phyo will now have time in jail to reflect on their horrific crimes.” said the Miller family.

Speaking about the decision, the Miller family have said they believe the “Thai police have found the killers” and “the Thai court process has been visibly very fair and effective.”

They added “Zaw Lin and Wai Phyo will now have time in jail to reflect on their horrific crimes.”
Lin and Phyo face the death penalty, but the Miller family are asking for leniency in the sentence.

2 Myanmer men on death row for 2014 Koh Tao murders launch final appeal
22 August 2017
The two Myanmar nationals on death row for the savage 2014 murders of British backpackers Hannah Witheridge and David Miller on Koh Tao filed their last appeal today.

This 300-page document, handed in to the Supreme Court, states that the forensic eveidence, including DNA tests used to convict migrant workers Zaw Lin and Win Zaw Htun, both 22, was not carried out according to international forensic standards, reported Bangkok Post.

Lawyer Nakhon Chompuchat, leader of the men’s defense team, was turned down by the Appeal Court in March.

The Appeal Court ruled that the evidence was collected correctly and that the men had committed the rape of Witheridge and both murders “without a doubt” on Sept. 15, 2014. The death sentence was upheld for both men...

Interesting twist to the story'
The National Crime Agency in the UK has been forced to admit it acted unlawfully when it gave information to Thai police that helped send two men to death row for murdering two British backpackers
The NCA supplied phone record evidence and intelligence to investigators in Thailand following the September 2014 murders of Hannah Witheridge, 23, and David Miller, 24, on the island of Koh Tao.

3 years on, and still so many questions remain surrounding the murders of the British holidaymakers, and also other unexplained deaths of foreigners on Koh Tao.

The Supreme Court of Thailand has accepted the final appeal of Zaw Lin and Wai Phyo, the two migrant workers sentenced to death for the murders of British Tourists Hannah Witheridge and David Miller on Koh Tao.
The final appeal from the lawyers representing the two men was submitted to the court on August 21st.
The 319 page document points to evidence that Wai Phyo and Zaw Lin had been denied justice and fairness and are innocent of the crimes of which they have been convicted.

Reward offered for information on the 2014 Hannah Witheridge and David Miller murders on Koh Tao
27 June 2018
A man, who has asked to remain anonymous, has asked the Samui Times to publish his intent to pay 500,000 Thai Baht to anybody who has information, video, CCTV or was a witness to the murders of Hannah Witheridge and David Miller on Koh Tao in September 2014.

Mr X told the Samui Times that he has spent the last four years looking at the evidence of the case and finds it strange that no witnesses ever came forward, no CCTV was ever presented and it seems not a single person was ever witness to any of the events of that evening. He said “a crime of this magnitude could simply not have taken place without a single witness, I think there are witnesses out there who so far have been afraid to come forward, however now a significant amount of time has passed perhaps somebody has left the island now who saw something, or maybe somebody has had a change of heart but thinks its too late to come forward. I am happy to pay up to 500,000 Thai baht to anybody who is prepared to speak at this stage”

Mr X did not reveal his motivation for the reward, although he did prove funds available at the time of publication.

Actually if one follow this case one would have concluded long ago that these 2 "culprits" are innocent. Rumours had been floating around for a long time the real killer is a son of a rich man in the south and this is not his first victim, just hearsay only.
