Kem Ley Murder Video Sought in US Court

Exiled opposition leader Sam Rainsy has submitted a request to a U.S. court asking energy giant Chevron to release surveillance footage of government critic Kem Ley’s murder at one of its Caltex stations in Phnom Penh.

The lawsuit at the U.S. District Court, dated December 13 and signed by Cambodian citizens, calls upon Chevron to release documents and recordings from the period before and after Kem Ley’s July 10 murder.

It asks for the release of “all audio or video recordings taken during the period of July 1-14, 2016” in and around the Caltex gas station and its Star Mart convenience store, where the shooting occurred.

The request also seeks documents identifying the names of managers and employees at the station during the same period, including those who resigned in the weeks after the shooting.

It also asks for the release of “all communications with any agent, employee or instrumentality of the Cambodian government” regarding Kem Ley’s assassination...


Caltex is a subsidiary of Chevron, which is based in San Francisco, California. Chevron’s representative in Cambodia did not respond to a request for comment.

Court Finishes Kem Lay Investigation
Thursday, 29 December 2016

The Phnom Penh Municipal Court closed its investigation last week into the murder of political commentator Kem Lay, with at least one analyst saying it was not conducted properly.

Investigating judge Seng Leang sent a letter to Mr. Ley’s wife, Bou Rachana, informing her that the court had wrapped up its investigation.
“After investigating and collecting evidence in the case, the Phnom Penh Municipal Court has decided to close the investigation into this case,” read the letter, which was signed by judge Leang and dated last Friday...

Subpoena for footage of Kem Ley shooting approved

Former opposition leader Sam Rainsy moved one step closer to procuring video footage he hopes will help prove government involvement in Kem Ley’s assassination, while one political commentator may be facing a lawsuit for comments suggesting as much.

“A North California District Court has granted the right to subpoena the US company Chevron for video footage of the shooting of Dr. Kem Ley,” Rainsy wrote in a Facebook post on Friday.

On July 10, Ley was gunned down in a Chevron-owned Caltex in a murder widely seen as politically motivated. Thus far, Caltex has only given the footage to the Cambodian government.

Rainsy has long maintained that the government was involved in Ley’s death, a stance that earned him a defamation charge from Prime Minster HE.

US judge Donna Ryu issued the decision on Thursday, writing that Rainsy “may serve a finalised version of the subpoena” to Chevron, which demands that the US oil giant release two weeks’ worth of video recordings, among other documents.

Chevron will have 30 days to contest the subpoena once it has been served. But Buntenh, an activist monk who has long demanded the video’s release, said the court ruling was “the right decision”.

“The killing of Kem Ley was not by chance. There may be other people involved and hidden agendas that the government doesn’t want us to know,” he said.

Political analyst Ou Virak, however, said he expects Chevron to ultimately avoid releasing the footage.

“They don’t want to be on the wrong side of the people who have power,” he said...

Kem Ley’s Family Plans $170,000 Marble Stupa

Family members of murdered political analyst Kem Ley conducted a blessing ceremony on Wednesday in Takeo province on the future site of a $170,000 marble memorial stupa, despite the objections of some supporters and the purported wishes of Kem Ley himself.

Kem Ley’s elderly mother, Phok Se, joined his sister, monks and a few extended family members to bless the site in Ms. Se’s backyard in Tram Kak district’s Angtakob village, said Sao Kosal, a member of the stupa committee

The stupa will be 16 meters tall and constructed of marble, rather than the typical brick, as that is what Ms. Se wants, Mr. Kosal said.
The stupa committee has raised $6,000 so far. It expects donors in Cambodia and abroad to contribute the rest...
